By accessing or using Scenti-fied ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Maintain the security of your account credentials

4. Buyer Terms

As a buyer, you agree to:

5. Seller Terms

As a seller, you agree to:

• Provide accurate product descriptions and images
• Ship products within the stated timeframe
• Respond to buyer inquiries promptly
• Honor the return policy as stated
• Comply with all applicable laws and regulations
• Not sell prohibited or illegal items

6. Prohibited Activities

You may not:

• Use the Platform for any illegal purpose
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Circumvent security measures or interfere with the Platform
• Scrape or collect user data without permission
• Manipulate reviews or ratings

7. Fees and Payments

Sellers are charged a transaction fee of 5% of the sale value, with no monthly fees. This fee is deducted from the seller's payout for each completed sale. All fees are non-refundable unless otherwise stated. We use secure third-party payment processors and do not store your full payment information.

8. Intellectual Property

All content on the Platform, including logos, designs, and software, is owned by Scenti-fied or its licensors. You may not copy, modify, or distribute this content without permission.

9. Limitation of Liability

Scenti-fied is a marketplace platform connecting buyers and sellers. We are not responsible for the quality, safety, or legality of items listed. We do not guarantee any transactions and are not liable for any damages arising from your use of the Platform.

10. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with applicable laws. You agree to waive any right to a jury trial or to participate in a class action.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Kenya.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may also delete your account at any time.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms. We will notify you of material changes via email or Platform notification.
